Preamble<\/h2>\n

The mission of PaarBalance is to help people through relationship crises and to teach them, step by step, the ingredients for a happy partnership. Through the free PaarBalance relationship test and the paid PaarBalance online coaching, we aim to help participants gain a deeper understanding of constructive relationship building, lead more fulfilling relationships, and improve their own quality of life.<\/p>\n

Therefore, PaarBalance offers the option of entering into an information agreement at various points. PaarBalance commits to regularly providing those subscribing to this information agreement with further education and training materials, as well as general information. The subject matter of each information agreement is defined both by the specific order and additionally by these General Information Terms and Conditions (GTC). The subscriber may terminate the agreement at any time, without giving reasons and without any formal requirements. This information service is free of charge.<\/p>\n

\u00a7 1 Subject matter of the contract, obligations of PaarBalance<\/h2>\n
  • The subject of this agreement is that PaarBalance will provide the subscriber with information via various communication channels (email, postal mail, SMS, social networks, and similar channels). The topics covered by this information are generally defined in the specific information agreement (product and\/or service description). This may include information from the following areas: relationship tips, personal development, coaching, sexuality; information about new products, literature recommendations, seminars, workshops, events, scientific studies and publications, as well as offers from PaarBalance or third parties.<\/li>\n
  • With regard to paragraph 1, PaarBalance is also obligated, among other things, to deliver the information covered by this agreement via social networks and comparable communication channels. To this end, PaarBalance is obligated, to the extent technically possible, to upload the email address to a Custom Audience on Facebook or a “similar audience” on Google and, if possible, to deliver information there as well. This is subject to the provision in paragraph 3.<\/li>\n
  • PaarBalance is furthermore obligated to exclude those who have already subscribed to its email distribution list from advertisements aimed at potential new customers on Facebook or Google, within the limits of its technical capabilities. To do this, PaarBalance must upload the email address to a Custom Audience on Facebook or a “similar audience” on Google. Those who have subscribed to the information will then be excluded from advertisements aimed at potential new customers.<\/li>\n
  • There is no guarantee that all these topics will be covered.<\/li>\n
  • Furthermore, PaarBalance is not obligated to provide advice or to verify the accuracy of this information, but only to provide the information.<\/li>\n

    \u00a7 2 Obligation of the information requester to verify information before concluding a contract, mandatory status: legal age.<\/h2>\n

    Before concluding a contract, each person requesting information is obligated to verify that they are of legal age and that they are entering into the information contract for themselves. Only if the person requesting information is of legal age may they enter into the information contract. If they conclude the information contract, PaarBalance may assume that the person requesting information is of legal age or has the consent of their legal guardian(s).<\/p>\n

    \u00a7 3 Conclusion of Contract<\/h2>\n

    The information contract is concluded when the information requester requests a service from PaarBalance and\/or Klick-Tipp, either digitally, in writing or in another unambiguous (including implied) form, in whose product or service description references the conclusion of an information contract.<\/p>\n

    These AIBs also become part of the contract.<\/p>\n

    \u00a7 4 Free of charge<\/h2>\n

    The person requesting the information does not have to pay any money for obtaining the information.<\/p>\n

    \u00a7 5 Termination of the Information Agreement<\/h2>\n

    Both contracting parties may terminate the contract at any time, without giving reasons and without observing a notice period.<\/p>\n

    \u00a7 6 Liability<\/h2>\n
  • PaarBalance is liable without limitation only for intent and gross negligence.<\/li>\n
  • For simple negligence, PaarBalance is liable \u2013 except in the case of injury to life, body or health \u2013 only if essential contractual obligations (cardinal obligations) are violated.<\/li>\n
  • Liability for indirect and unforeseeable damages, loss of production and use, lost profits, lost savings and pecuniary losses due to third-party claims is excluded in the case of simple negligence \u2013 except in the case of injury to life, body or health.<\/li>\n
  • Any liability exceeding that stipulated in this contract is excluded \u2013 regardless of the legal nature of the claim asserted. However, the foregoing limitations or exclusions of liability do not apply to mandatory statutory strict liability (e.g., under the Product Liability Act) or liability arising from a strict liability guarantee.<\/li>\n
  • To the extent that liability is excluded or limited under paragraphs 2 and 3, this also applies to the personal liability of PaarBalance’s employees, workers, representatives, officers and agents.<\/li>\n

    \u00a7 7 Right to Amend<\/h2>\n

    PaarBalance is entitled to unilaterally amend these General Terms and Conditions (GTC) to the extent necessary to rectify any subsequent imbalances in the contractual relationship, to adapt to changes in legal or technical requirements, or to expand the range of information offered or the information channels. The information recipient will be notified of any amendment, including the content of the amended provisions, via their last known email address.
